Terms of Membership — Niya®

These Terms of Membership constitute a legally binding agreement between ETTAI Comm.V., a company registered in Belgium with enterprise number BE 0649.400.251, with registered address at Deudondreef 32, 2860 Sint-Katelijne-Waver, Belgium, operating the Niya® community (hereinafter “Niya”), and any individual who submits a waitlist form, pays the assessment fee, or holds active membership in any Niya tier (hereinafter “you” or “the member”).
By submitting the waitlist form, paying the assessment fee, or activating a membership, you confirm that you are at least 18 years of age, that you have read and understood these terms in full, and that you accept them without reservation. If you do not accept these terms, you may not proceed with the assessment or activate a membership.
These terms are available at all times at niya.life/terms-of-membership. The version in force at the time of your application or most recent renewal is the version that governs your membership.
Niya® is a private, values-based membership community for individuals who operate from clean intentions, trusted intuition, and a genuine direction in life.
Niya is not therapy. It is not coaching. It is not consulting. It is not a wellness programme. It is not a professional network. It is not a personal development course. Nothing communicated within the Niya community by Niya, its founder, or any member constitutes professional medical, psychological, legal, financial, or any other regulated professional advice. You are solely responsible for any decisions you make as a result of your participation in the community.
If you require professional support of any kind, you must seek a qualified and appropriately licensed professional independently.
Participation in Niya does not guarantee any specific outcome, result, personal development, business result, or benefit of any kind.
Membership is open to individuals who are at least 18 years of age. Organisations, companies, and legal entities may not hold membership. Membership is personal and non-transferable.
By applying, you confirm that all information you provide during the assessment process and at any point during your membership is truthful, accurate, and complete. Providing false or misleading information at any stage constitutes grounds for immediate termination without refund.
Niya reserves the absolute right to refuse any application without being required to provide a reason.
Access to the Niya community requires completion of the Niya assessment process. The assessment consists of a series of videos and honest reflection questions submitted via the waitlist form on niya.life.
Every application is reviewed by a human being. No automated decision-making or algorithmic profiling is used in the assessment. Niya’s decision on any application is final and is not subject to appeal.
Assessment fee: €47 / $47, payable at the time of application. Payment of this fee initiates the assessment process. It covers the time and human attention dedicated to reviewing your application. It does not guarantee admission.
If your application is not accepted: The assessment fee is returned in full within 14 calendar days of notification of that decision, by the same payment method used at the time of payment. No other compensation is payable.
If your application is accepted: The assessment fee is non-refundable. Your first month of Individual or Niya Pro membership is included at no additional charge and activates immediately upon acceptance.
You will receive a personal response to your application within 72 hours of submission. If you do not receive a response within this period, contact rachid@niya.life. The 72-hour period is a target, not a contractual guarantee. Delays caused by circumstances outside Niya’s reasonable control do not constitute a breach of these terms.
Observer — Free
Read-only access to Niya principle content, the manifesto, and the origin story. No participation rights. No assessment required. Observer status does not constitute membership and does not grant access to the community, sessions, or any member features. Observer status may be withdrawn at any time without notice or compensation.
Individual — €19 / $19 per month (founding rate, first 50 members) / €29 / $29 per month (standard rate from member 51)
Full community access. Monthly live sessions with Rachid Et-Taibi. Monthly wisdom contributions. Access to the Silent Room.
The founding Individual rate of €19 / $19 is available exclusively to the first 50 members who activate an Individual membership. This rate is locked for life on the condition that membership remains continuous and uninterrupted. If a founding Individual member cancels their membership for any reason and subsequently rejoins, the standard rate of €29 / $29 applies. The founding rate does not transfer to any other person or account.
Niya determines solely and finally whether a member qualifies as one of the first 50. In the event of a dispute regarding founding status, Niya’s records are conclusive.
Niya Pro — €49 / $49 per month (founding rate, first 50 members) / €149 / $149 per month (standard rate from member 51)
Everything included in Individual, plus access to the dedicated business owner community, the Niya trust network, and cluster access by region. Monthly invoicing. Tax deductible where applicable under Belgian law. The founding Niya Pro rate of €49 / $49 is subject to the same continuity condition as the founding Individual rate described above.
Dollar and euro pricing are set at parity. No currency conversion is applied between the two. Prices are stated inclusive of applicable VAT where required by Belgian law. Members are responsible for any taxes applicable in their own jurisdiction beyond Belgian VAT.
Membership fees are billed monthly at the start of each billing period. Payment is due immediately upon billing. Access to the community may be suspended without notice if payment fails and is not resolved within 7 calendar days of the failed payment date. Niya is not liable for any loss of access resulting from payment failure attributable to the member.
Niya Pro members receive a monthly invoice. It is the member’s sole responsibility to provide accurate and current billing information and to notify Niya immediately of any changes at rachid@niya.life.
Niya reserves the right to adjust membership pricing at any time with a minimum of 30 calendar days written notice to active members delivered by email to the address on file. If you do not accept a price change, you may cancel your membership before the new price takes effect. Continued use of your membership after the effective date of a price change constitutes acceptance of the new price.
Founding rates are exempt from price increases for as long as the continuity condition set out in clause 5 is met.
You may cancel your membership at any time by sending a written cancellation request to rachid@niya.life from the email address associated with your membership. Cancellation requests submitted by any other means are not valid.
Cancellation takes effect at the end of the current billing period. You retain full access to the community until the end of that period. No refund is issued for any remaining days in the current billing period.
Cancellation of a founding Individual or Niya Pro membership results in permanent and irrevocable loss of the founding rate. This is stated clearly here and cannot be waived after the fact.
Your cancellation request will be acknowledged by email within 5 business days. If you do not receive acknowledgement within that period, contact rachid@niya.life immediately. The absence of acknowledgement does not affect the validity of a correctly submitted cancellation request.
The assessment fee is refunded in full if your application is not accepted, within 14 calendar days of that determination, by the original payment method.
The assessment fee is non-refundable if your application is accepted, regardless of whether you subsequently choose to activate or use your membership.
Monthly membership fees are not refundable once a billing period has commenced, except in the following specific circumstances: where Niya terminates your membership for reasons unrelated to any breach of these terms or the Niya Rules, a prorated refund of the unused portion of the current month’s fee will be issued within 14 calendar days; or where required by mandatory provisions of Belgian consumer protection law that cannot be contracted out of.
No refund is issued to any member who disputes a payment via their bank or payment provider before first contacting Niya directly at rachid@niya.life and allowing a minimum of 14 calendar days for resolution. Niya reserves the right to terminate immediately and without refund the membership of any member who initiates a payment dispute without first following this process.
By accepting these terms, you commit to the ten Niya Rules. These Rules are not aspirational. They are the condition of your membership. Breach of any Rule is grounds for termination.
One. Your intentions are clean. Toward yourself, others, and the world.
Two. You trust your intuition. You stopped overriding it with fear and other people’s expectations.
Three. You have a direction. Not a goal. A genuine direction that came from inside you.
Four. You elevate. You do not compete. When someone here wins, you feel it as a collective win.
Five. You show up as yourself. No performance. No curated version.
Six. You protect the community. What is said here stays here. Always.
Seven. You give before you take. Generosity is the default.
Eight. You accept what you cannot control. You learn from it and move forward.
Nine. You do not judge. Other members, their path, their choices.
Ten. You live this. You do not wear it. Niya is not a badge. It is a way of being.
Niya reserves the right to update the Rules. Material changes will be communicated to active members by email with a minimum of 14 calendar days notice before the changes take effect. Continued membership after the effective date constitutes acceptance of the updated Rules.
The following conduct is strictly prohibited and constitutes grounds for immediate termination without notice or refund: sharing, reproducing, recording, distributing, or publicly referencing any content, conversations, disclosures, or information from within the Niya community to any person or platform outside the community in any format; harassment, intimidation, threatening, abusive, or discriminatory behaviour directed at any member or at Niya; misrepresentation of identity, professional background, or intentions at any point; commercial solicitation, advertising, or promoting products or services within the community without prior written consent of Niya; creating or attempting to create duplicate or anonymous accounts to circumvent a termination or restriction; any conduct that Niya reasonably determines to be harmful to the integrity, safety, reputation, or values of the community. This list is illustrative and not exhaustive.
Niya reserves the right to suspend or terminate any membership at any time with or without prior notice for breach of these terms or the Niya Rules, conduct harmful to the community, provision of false information, non-payment, or any circumstance where continued membership is incompatible with the community’s values.
Where termination follows breach, no prior warning is required and no refund is issued. Niya’s decision regarding termination is final and is not subject to appeal. A member whose membership has been terminated for breach may not reapply without the prior written consent of Niya.
Everything shared within the Niya community is strictly confidential. Members may not share, reproduce, publish, record, screenshot, summarise, paraphrase, or reference the personal disclosures, contributions, conversations, or identity of any other member outside the community in any format, through any medium, to any person, without the explicit prior written consent of the member concerned.
This confidentiality obligation survives the cancellation or termination of membership indefinitely. Breach of this obligation may entitle Niya and the affected member to seek injunctive relief and damages under applicable Belgian law without the need to prove specific financial loss.
Niya® is a registered trademark owned personally by Rachid Et-Taibi, residing in Belgium. All rights in the Niya® trademark are reserved exclusively to Rachid Et-Taibi in his personal capacity, independently of ETTAI Comm.V. Unauthorised use of the Niya® trademark, including any use that suggests affiliation, endorsement, or association with Niya without prior written consent from Rachid Et-Taibi personally, is prohibited and may result in legal action.
All content associated with Niya, including the methodology, copy, visual identity, session content, community structure, assessment process, and all materials published on niya.life or within the community, is the intellectual property of ETTAI Comm.V. and is protected under applicable Belgian and international intellectual property law.
Members are granted a personal, non-exclusive, non-transferable, revocable licence to access and engage with community content solely for personal non-commercial use within the community during the period of active membership. This licence terminates automatically upon cancellation or termination. It does not permit reproduction, redistribution, or commercial use of any kind.
To the maximum extent permitted by mandatory Belgian law, ETTAI Comm.V., as operator of the Niya community, and Rachid Et-Taibi, as trademark owner, are not liable for any indirect, incidental, consequential, punitive, or special damages arising from participation in the Niya community or from the acts or omissions of any member. Niya’s total aggregate liability to any member shall not exceed the total membership fees paid by that member in the 12 months immediately preceding the event giving rise to the claim. Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot lawfully be limited under Belgian law.
If you have a complaint, contact rachid@niya.life in writing. Niya will acknowledge within 5 business days and respond substantively within 21 calendar days.
Niya reserves the right to amend these terms at any time. Material amendments will be communicated to active members by email with a minimum of 14 calendar days notice. Continued use of membership after the effective date constitutes acceptance. If you do not accept an amendment, your only remedy is to cancel before the amendment takes effect under clause 7.
If any provision of these terms is found to be invalid or unenforceable, it shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions continue in full force.
These terms, together with the Privacy Policy at niya.life/privacy-policy, constitute the entire agreement between you and Niya with respect to your membership and supersede all prior representations, agreements, or understandings.
These terms are governed by Belgian law. Any dispute that cannot be resolved by mutual agreement within 30 calendar days of written notice shall be submitted to the exclusive jurisdiction of the courts of Antwerp, Belgium.
